Amounts and rules for the payment of unemployment benefits

Citizens of the Russian Federation who are registered receive an allowance of the prescribed amount, based on the maximum and minimum established by law:

The calculation is carried out in proportion to the income indicated in the certificate from the last job. A considerable number of errors relate to the preparation of a certificate of income. Often, citizens confuse the 2-NDFL form on the income of an individual with a certificate of average monthly earnings for an employment center. This is a very common mistake, especially for those citizens who seek help for the first time. For this reason, the specialist may postpone the day of registration. To avoid such misunderstandings, you should immediately ask for the required certificate form at the labor exchange and give it to the accountant at the last place of work for filling out.

    Maximum allowance

    The amount of maximum cash payments for unemployment established by law is paid in the amount of 4900 rubles. It is accrued to persons who had a high average income at the previous place of work, paid service of 26 calendar weeks. The calculation takes into account only the official salary. The reason for dismissal plays a role; for violators of labor discipline, the amount of the allowance is reduced.

    Minimum Benefit

    The smallest amount of unemployment benefit is 850 rubles and is calculated in the following cases:

    • previously unemployed citizens;
    • a break between dismissal and applying to the Employment Center for more than a year;
    • the reason for dismissal is a violation of labor discipline and other misconduct;
    • having paid experience at the previous place of work less than 26 weeks;

    The basis for the calculation is the average earnings at the last job, but within the minimum and maximum amounts (in the amount of 850 and 4900 rubles). The order of money transfers has two 12-month periods, and at first the amount is calculated in a similar way:

    • first three months - the amount of the payment is 75% of the salary;

    The procedure for paying unemployment benefits

    The main document that regulates the calculation of benefits is the “Law on Employment of the Population” No. 1032-1 of April 19, 1991. Money is transferred monthly within 36 calendar months, but not more than 12 months in total terms (edition of the Federal Law No. 361-FZ of November 30, 2001). The minimum and maximum size is prescribed in the Decree of the Government of the Russian Federation of 08.12.2016. If the employee was dismissed due to reduction or due to the liquidation of the enterprise, the benefit is accrued after the completion of the payment of the average wage (as amended by 367-FZ of December 27, 2009).

    In the first 12-month period, assistance is paid within the established limits of the maximum and minimum amount (850 and 4900 rubles). In the second 12-month period, the minimum amount of the payment is accrued, which is multiplied by the percentage value of the coefficient of the region where the unemployed (if any) lives, in fact it is 850 rubles.

    Accrual procedure

    Assistance is accrued from the first day a person is recognized as unemployed. Next, the amount is calculated (no more than the maximum allowance of 4900 and not less than 850 rubles), after which the amount is transferred to the non-cash account indicated by the citizen in Sberbank. Children (up to 23 years old) left without parental care are paid an additional benefit - a bonus - 850 rubles for six months.

    Payment terms

    It is recommended not to delay visiting the employment center after dismissal, because the subsidy is not accrued from the moment of dismissal, but after passing the procedure for official recognition as unemployed. The allowance is paid monthly until the 26th day (allowed twice a month, but no more). The main condition for maintaining payments is the need to regularly register with the inspector of the Employment Center for re-registration, for non-fulfillment, payments are suspended.

    Payment duration

    The terms for payment of unemployment benefits are 24 months, with a maximum duration of a job search of up to three years. However, there are categories of the unemployed for whom the cash bonus can be extended:

    • the length of service is 25 years or more, but the retirement age has not yet come (the payment is extended by two weeks for each year worked that exceeds the length of pension insurance);
    • a person was fired due to the liquidation of an enterprise or a reduction in staff - it is possible to apply for an early pension if no more than two years are missing before it (Articles 27, 28 of the Federal Law "On Labor Pensions of the Russian Federation").

    Grounds for termination of payments

    Payments are terminated simultaneously with deregistration in the following cases:

    • job search completed;
    • not visiting the Employment Center for more than a month;
    • moving to another region;
    • deception of the employment service;
    • personal initiative of the unemployed person (upon a written application);
    • appointment of an old-age pension, for years of service;
    • condemnation of the unemployed and sending him to places of deprivation of liberty or to corrective labor;
    • payment of scholarships when taking retraining courses in the direction of the Employment Center.
    • death of an unemployed person (heirs receive a lump sum payment in the amount of the maximum monthly allowance).
